Brook Highland is truly one of the best neighborhoods in Shelby County and the surrounding area. We think one of the best parts about Brook Highland is the residents. We take pride in our homes, neighborhood and community. The Protective Covenants provide a framework to ensure we maintain consistency in our appearance and value as a neighborhood. However, sometimes life happens, and we may neglect our commitment to our neighbors. Administration of the Protective Covenants is one of the key tasks for the HOA. While most residents willingly respond to violation notices, some do not. Neglected violations affect the value of our collective property and result in additional administrative costs to all residents. Therefore, the Board of Directors is instituting an enforcement policy to defray these costs caused by individual residents and to encourage overall compliance.
It is important to note that the Protective Covenants require Architecture Review Board approval prior to making any changes to your property. Thus, failure to request ARB review prior to making changes will be considered a violation and subject to this enforcement policy.
The intent of the policy is not to penalize residents, nor does it allow violations to continue (by paying a fine). The policy is intended to encourage compliance through prior communication to address non-compliances and to preclude future violations by ensuring ARB review in advance.
Attached is our Enforcement Policy which will go into effect July 1, 2023.
